Joburg City satisfied with Constitutional Court ruling

The City of Johannesburg said it was "extremely satisfied" with today's judgement that upheld the position that the property owner cannot divest (free oneself) him or herself of all responsibility on arrears incurred by tenants in respect of water and electricity accounts.

"The judgement confirmed that the City is applying best and credible practises in dealing with its clients. This was a balanced judgement in that it strengthened the hand of the municipality and also gave something to the rate-payers as well," said City spokesman Gabu Tugwana.

In the first instance, the judgement meant that it is business as usual for the City of Johannesburg in its operating procedures of ensuring that outstanding accounts are settled before clearance certificated are issued.

In the second instance, it meant the City would continue to provide the landlord copies of municipal services accounts on written request.

"We hope this settles the dispute and the City and landlords can work together in creating a good environment to make Johannesburg an African World Class City," added Tugwana.
